1. Acceptance of Terms
Welcome to Pro Landscaping AI ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our customer relationship management (CRM) platform, mobile applications, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
If you are using the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

- Quoting & Invoicing - Create quotes, invoices, and process payments
- Crew Management - Track employees, crews, and equipment
- SMS/Text Messaging - Send appointment reminders and notifications to customers
- Mobile Applications - Field crew apps for job management and GPS tracking
- Lead Generation - Access qualified leads in your service area (Enterprise plan)
3. SMS/Text Messaging Terms & Opt-In
📱 SMS/Text Messaging Consent
By providing your mobile phone number and agreeing to receive text messages, you expressly consent to receive recurring automated text messages from Pro Landscaping AI and businesses using our platform.
- Message frequency varies based on your service schedule and account activity
- Message and data rates may apply depending on your mobile carrier
- Consent is not a condition of purchase
- You can opt out at any time by replying STOP to any message
3.1 Types of Messages
When you opt in to SMS communications, you may receive the following types of messages:

4. Account Registration & Security
4.1 Registration
To use the Service, you must register for an account by providing accurate and complete information. You agree to update your information to keep it current.

- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach

5. Subscription & Billing
5.1 Plans
We offer multiple subscription tiers:

- Professional - Advanced features including route optimization
- Enterprise - Full platform access including lead generation marketplace
5.2 Payment Terms
- Subscriptions are billed monthly or annually in advance
- All fees are non-refundable except as required by law
- We may change pricing with 30 days notice
- Failed payments may result in service suspension
5.3 Lead Generation Credits
Enterprise customers may purchase lead credits to acquire qualified customer leads. Lead credits are non-refundable but may be eligible for dispute if lead quality standards are not met.
6. Data Privacy & Security
6.1 Your Data
You retain ownership of all data you input into the Service, including customer information, job records, and communications. We process this data solely to provide the Service.
6.2 Data Security
We implement industry-standard security measures including:
- Encryption of data in transit and at rest
- Multi-tenant data isolation
- Regular security audits and monitoring
- Secure data centers with physical access controls
6.3 Data Backup
We maintain regular backups of Service data. However, you are responsible for maintaining your own backups of critical business data.

When using our Service to communicate with your customers, you agree to:
- Obtain proper consent before sending SMS messages
- Honor opt-out requests promptly
- Comply with all applicable privacy laws (TCPA, CCPA, etc.)

7. Acceptable Use Policy
You agree NOT to use the Service to:
- Send spam, unsolicited messages, or messages to numbers without consent
- Violate any laws or regulations, including TCPA, CAN-SPAM, and CCPA
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to systems or data
- Interfere with or disrupt the Service or servers
- Impersonate others or misrepresent your identity
- Use the Service for any illegal or fraudulent activity
- Resell or redistribute the Service without authorization

9. Disclaimers & Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We do not guarantee uninterrupted or error-free operation. We may perform maintenance that temporarily affects availability.
9.2 No Warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9.4 Third-Party Services
The Service may integrate with third-party services (payment processors, mapping services, etc.). We are not responsible for the availability, accuracy, or practices of these third-party services.
10. Termination
10.1 By You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
10.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms or our Acceptable Use Policy
- Fail to pay fees when due
- Engage in fraudulent or illegal activity
10.3 Effect of Termination
Upon termination:
- Your access to the Service will be disabled
- You may request export of your data for 30 days after termination
- We may delete your data after 90 days
- Provisions that should survive termination will remain in effect
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
